Calculation of Term

A Supplementary Protection Certificate is valid from the end of the maximum term of the basic patent. Its additional term depends on when the protected product receives its first marketing authorization (first authorization to place it on the market).

First, the difference of this date and the filing date is calculated. Then, another five years are subtracted from the result. If this results in a period of more than five years, the additional term nevertheless remains limited to five years.
